Official Sweepstakes Rules
OFFICIAL RULES AND REGULATIONS OF GOTFRAG LLC SWEEPSTAKES (“Sweepstakes”)
NO PURCHASE NECESSARY TO ENTER OR WIN. Void where prohibited or restricted by law.
1. ENTRY PERIOD: The Entry Period begins at 12:00:01 a.m. Eastern time on 8/22/07 and ends at 11:59:59 p.m. Eastern time on 8/31/07 (“Entry Period”). GOTFRAG LLC (“Sponsor”) will advertise and post on its website two Sweepstakes prizes during the Entry Period.
2. ELIGIBILITY: Sweepstakes participation is open only to legal residents of the 50 United States and Washington, D.C. who are eighteen (18) years of age or older at the time of entry. Employees of GOTFRAG LLC or Microsoft and members of their immediate family (parents, siblings, children, spouses) and individuals residing in the same household are not eligible to participate in the Sweepstakes or win a prize.
3. HOW TO ENTER THE SWEEPSTAKES: Participants have the opportunity to win a prize pack (see #4 for prizes). Participants should note on each entry form the prize for which they are competing. Participants may submit as many entries as they wish for as many prizes as they wish, but must include only one prize category per entry. Participants must have an account registered at GotFrag.com to enter. To enter via message system, send a user message to SidewinderSweeps during the Entry Period. Participants entering the Sweepstakes by email must provide their full name, address, phone number, a valid email address and the prize for which they are competing. To enter via regular mail, participants must mail a 3 X 5 card requesting entry in the Sweepstakes to “Sweepstakes, GotFrag.com, 25 Health Sciences Drive Suite 211, Stony Brook, NY 11790” and include their full name, address, phone number, a valid email address and the prize for which they are competing. Limit: one entry per postmarked outer envelope or email, and one prize category per entry. All entries must be received by Sponsor no later than 11:59:59 p.m. Eastern time on 8/31/07 to be eligible to win. All entries must include a valid email address to be eligible for the drawing.
Participants may enter the Sweepstakes as often as they wish; provided, however, that entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be void. Sponsor is not responsible for any entries that are lost, destroyed, illegible, incomplete, or postage-due and such entries shall be void. All materials submitted become the property of the Sponsor and will not be returned. By entering the Sweepstakes, participants agree to be bound by these Official Rules and Regulations.
4. PRIZES:
Prizes will consist of:
- SideWinder ™ Mouse
- LifeChat ™ LX-3000 Headphones
- Three G4W (Games for Windows) Games: Hell Gate London, Bioshock and Crysis
- G4W Lava Lamp
- Sidewinder Swag - including tats and stickers.
The aforementioned prize descriptions are general prize descriptions. Specific prize descriptions are subject to availability and Sponsor’s sole discretion.
Prizes cannot be transferred or exchanged and must be accepted as awarded, with no substitutions or cash equivalents of any kind; provided, however, that Sponsor reserves the right to substitute a prize of comparable value at Sponsor’s sole discretion if the stated prize becomes unavailable. All taxes on prizes and all other costs and expenses associated with the acceptance and use of any prize not specified herein as being awarded are solely the winner’s responsibility.
5. SWEEPSTAKES DRAWING: A random drawing will be conducted two days after the end of each sweepstakes from among all eligible entries received to select one winner for each Sweepstakes prize, limit of one Prize per participant. The drawing will be conducted under the supervision of the GOTFRAG LLC President, whose decisions will be final on all matters relating to the Sweepstakes. The odds of winning each prize will depend on the total number of eligible entries received.
6. HOW TO CLAIM A PRIZE: The prize winners do not have to be present at the drawing to win. Each potential Sweepstakes winner will be notified by e-mail no later than 9/15/07 and will be required to sign and return an Affidavit of Eligibility and Release (unless prohibited by applicable law) and a W-9 Form within fourteen (14) business days of receiving such notification and documentation. Within four (4) to six (6) weeks after Sponsor receives the potential winner’s completed documentation, Sponsor will verify the potential winner’s eligibility and will ship the prize to the eligible winner, along with a prize receipt. Liability of Sponsor for any error in the delivery of any prize is limited to replacement while supplies last. A potential winner will be disqualified from the Sweepstakes and will forfeit the prize if he or she declines to accept the prize, fails to return all of the required documentation to the Sponsor within the specified time frame or if any prize notification or the prize itself is returned as undeliverable. Winners who fail to redeem their prizes within the time frame specified on the prize receipt may forfeit their prize.
Potential winners may be required to furnish proof of identification that may include a driver’s license or social security number, as determined by Sponsor. Unclaimed prizes will not be awarded.
By accepting the prize, the winner consents to the use of his or her name, address, voice, and statements relating to the Sweepstakes or Sponsor, and consents to the use of his or her photograph or other likeness, without further compensation, notification or permission, in any advertising or publicity carried out by Sponsor in any and all media except where prohibited by applicable law.
7. CONDITIONS OF PARTICIPATION: Each participant agrees to be bound by the decisions of the Sponsor and the GOTFRAG LLC President, which shall be final and binding on all matters relating to the Sweepstakes. Each participant also agrees, for himself/herself, and on behalf of his/her personal representatives, beneficiaries, heirs and permitted successors and assigns, to release, defend, indemnify, and hold harmless Sponsor, GOTFRAG LLC, Microsoft Corporation (“Prize Provider) and their subsidiaries, affiliates, successors, assigns, and prize providers, and their respective trustees, directors, officers, employees, agents, and representatives from any and all losses, costs, injuries and/or damages caused, or claimed to be caused by participation in the Sweepstakes or by the acceptance, possession, or use of any prize awarded, including, but not limited to, claims, losses, and/or damages for personal injury (including death) and/or property damage. Each participant consents to the jurisdiction and venue of the federal, state and local courts of Suffolk County of the State of New York for the resolution of all claims and disputes.
8. GENERAL CONDITIONS: Without limiting the generality of the foregoing, Sponsor reserves the right in its sole discretion to cancel, modify, or suspend the Sweepstakes without notice if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Sponsor corrupt the administration, security, or fairness of the Sweepstakes.
Neither Sponsor nor GOTFRAG LLC shall be responsible for (i) any problems or errors that may arise, including but not limited to, technical malfunctions of telephone network or lines, computer online systems, servers or providers, computer equipment or software, viruses, bugs, failure of personal computers and/or software and hardware configurations, or failure of any e-mail to be received by Sponsor or a participant for any reason including but not limited to traffic congestion on the Internet or at any website or any combination thereof; (ii) damage to a user’s system occasioned by participation in the Sweepstakes or downloading any information necessary to participate in the Sweepstakes; or (iii) any computer, technical, printing, typographical, human or other error relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in the administration of the Sweepstakes, the announcement of the prizes, the processing of entries, the claiming of prizes, or in any Sweepstakes-related materials.
Sponsor reserves the right, in its sole discretion, to disqualify any individual who: (i) does not comply with these Official Rules and Regulations; (ii) is ineligible to participate in the Sweepstakes; or (iii) violates any law applicable to the administration of or participation in the Sweepstakes and any such individual will forfeit any prize he or she may have won. In addition, Sponsor reserves the right to seek damages from any such individual and/or to pursue prosecution of such individual to the fullest extent permitted by law.
In the event of a dispute over the identity of a participant who enters the Sweepstakes via email, an entry will be deemed made by the authorized account holder of the of the email address provided at the time of entry.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules and Regulations, or the rights and obligations of any participant and/or Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of New York without regard to New York’s conflicts of law principles.
